Refund Policy

1. General Policy

At AetherNovaTech, we are committed to delivering high-quality custom software solutions. Due to the bespoke nature of our services, refunds are evaluated on a case-by-case basis.

2. Milestone-Based Refunds

Projects are delivered in clearly defined milestones. If a milestone does not meet the agreed specifications, you are entitled to a revision at no additional cost. If we are unable to meet the specifications after reasonable revision attempts, a partial refund proportional to the remaining work may be issued.

3. Cancellation Refunds

  • Before project commencement: Full refund of any advance payment, minus administrative fees
  • During active development: Refund for undelivered milestones only, based on work completed
  • After final delivery: No refund unless the deliverable materially differs from the agreed specifications

4. Non-Refundable Items

The following are non-refundable:

  • Work completed and accepted under previous milestone approvals
  • Third-party licensing fees or infrastructure costs already incurred
  • Consulting or advisory hours that have been delivered

Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by AetherNovaTech ("we," "us," or "our"), you ("the Client") agree to be bound by these Terms of Service. These terms apply to all custom software development, consulting, and related services provided from our office at Calle Laurel, 4, 26001 Logroño, España.

2. Scope of Services

All services are provided as described in the project proposal or statement of work (SOW) agreed upon by both parties. Any modifications to the scope must be documented in a written change order signed by both parties.

3. Intellectual Property

Upon full payment, all custom code, designs, and deliverables specifically created for the Client under the project SOW are transferred to the Client's ownership. Pre-existing frameworks, libraries, tools, and methodologies used by AetherNovaTech remain our intellectual property, with a perpetual, non-exclusive license granted to the Client for use within the delivered project.

4. Payment Terms

  • Invoices are issued according to the milestone schedule defined in the project SOW
  • Payment is due within 14 days of invoice date unless otherwise specified
  • Late payments may incur a 1.5% monthly interest charge
  • We reserve the right to pause work if payment is more than 14 days overdue

5. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of the project. This includes business logic, technical specifications, source code, and any non-public project details. This obligation survives the termination of this agreement for a period of 3 years.

6. Limitation of Liability

AetherNovaTech's total liability under any agreement shall not exceed the total fees paid by the Client for the services giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

7. Warranty

We warrant that all deliverables will conform to the specifications defined in the project SOW for a period of 90 days following final delivery. During this warranty period, we will correct any defects that prevent the software from performing as specified, at no additional cost.

8. Termination

Either party may terminate the agreement with 14 days' written notice. In the event of termination, the Client shall pay for all work completed up to the date of termination. Completed milestones remain billable regardless of termination.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes shall be resolved in the competent courts of Logroño, La Rioja, España.
